1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Ardent Quest Enterprises, Inc. (“Company,” “we,” “us,” or “our”), governing your access to and use of our website located at https://ardentquest.com and any related SMS/MMS communications (collectively, the “Services”).
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Services immediately.
2. SMS Messaging and A2P 10DLC Compliance
2.1 Consent to Receive SMS Messages
By providing your mobile phone number and submitting a form on our website, you expressly consent to receive recurring automated or manually dialed text messages (SMS/MMS) from Ardent Quest Enterprises, Inc. at the mobile number you provide. These messages may include, but are not limited to:

—Appointment confirmations and reminders
—Follow-up communications related to your inquiry
—Marketing and promotional messages (where separately consented)
—Consent to receive SMS/MMS messages is not a condition of purchasing any goods or services from Ardent Quest Enterprises, Inc.
2.2 Message Frequency
Message frequency varies based on your interaction with our Services. You may receive up to 4 messages per month unless you have engaged in active communication with our system, in which case frequency may be higher. As always, message and data rates may apply for any messages sent to you from us and to us from you.

Message and data rates may apply. You are responsible for any charges assessed by your mobile carrier for sending or receiving SMS messages. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
2.4 How to Opt Out
You may opt out of receiving SMS/MMS messages from us at any time by replying “STOP” to the phone number of any message you receive from us. After you send the SMS message “STOP” to us, we will send you a final SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword “HELP” for more assistance, or you can get help directly at info@ardentquest.com.
2.5 Help

2.6 No Sharing of Opt-In Data
Your opt-in consent and mobile phone number will not be shared with, sold to, or used by any third party for their own marketing purposes. This data is used solely to provide you with the Services described herein.
2.7 Supported Carriers
Our SMS/MMS messaging is compatible with most major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Carrier availability may vary. Ardent Quest Enterprises, Inc. and Carriers are not liable for any delayed or undelivered messages.
3. Description of Services
Ardent Quest Enterprises, Inc. is a business consulting, marketing agency, and provides AI-powered systems and other marketing services designed for businesses. Our Services include SMS messaging for appointment confirmations & reminders, customer support follow-ups, service-related notifications & updates, and promotional marketing alerts.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.
4. Eligibility
You must be at least 18 years of age and a legal resident of the United States to use our Services. By using the Services, you represent and warrant that you meet these requirements.
5. User Responsibilities
You agree to:

—Use the Services only for lawful business purposes

—Not use the Services to transmit spam, unsolicited messages, or any content that violates applicable law
—Comply with all applicable federal, state, and local laws and regulations, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and California consumer protection laws

All content, trademarks, logos, software, and materials available through the Services are the property of Ardent Quest Enterprises, Inc. or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ARDENT QUEST ENTERPRISES, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Ardent Quest Enterprises, Inc. and its officers, directors, employees, agents, and successors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
